Terms and Conditions of Use of the Online Store

1. General Provisions

These Terms and Conditions govern the use of the FLORACTIVE LATVIA online store, including the purchase of goods, payment, delivery, withdrawal rights, and warranty conditions.

By placing an order in the online store, the Customer confirms that they have read and agree to these Terms and Conditions.

The Seller reserves the right to amend these Terms and Conditions at any time without prior notice. The current version is always available on the website.

2. Registration and User Account

The Customer is responsible for the accuracy of the information provided during registration.

The Seller shall not be liable for any losses resulting from incorrect or incomplete information provided by the Customer.

The Seller reserves the right to suspend or block a user account if fraudulent activity or a breach of these Terms and Conditions is detected.

3. Order Placement

An order is considered accepted after payment has been received and an order confirmation has been sent to the Customer.

The Seller reserves the right to refuse fulfillment of an order if:

  • the product is unavailable in stock;

  • a technical error in pricing or product description has been identified;

  • there is suspicion of fraudulent activity.

In such cases, any payment received will be refunded to the Customer.

4. Prices and Payment

All prices in the online store are indicated in euros (€) and include all applicable taxes.

Payment for products can be made using the following methods:

  • bank cards (Visa, Mastercard);
  • online banking;
  • Apple Pay (if available);
  • Google Pay (if available).

Payments are processed in a secure payment environment using licensed payment service providers. After successful payment, the Customer receives an order confirmation at the email address provided.

Order processing begins after the payment has been received.

5. Delivery

Delivery is carried out in accordance with the delivery terms specified in the online store.

Delivery times are approximate and may vary due to circumstances beyond the Seller's control.

The Seller shall not be liable for delivery delays caused by courier services, parcel locker operators, customs procedures, or force majeure events.

6. Returns and Exchanges

6.1. Consumers have the right to withdraw from a distance contract within fourteen (14) calendar days from the date of receipt of the goods, in accordance with the Consumer Rights Protection Law of the Republic of Latvia and Cabinet Regulation No. 255 on Distance Contracts.

6.2. To exercise the right of withdrawal, the Customer must send a written notice to the Seller by email or submit a withdrawal form within 14 days.

6.3. The Customer must return the goods no later than 14 days after submitting the withdrawal notice. Return shipping costs shall be borne by the Customer.

6.4. Returned goods must:

  • be in their original packaging;

  • be complete with all accessories and components;

  • be undamaged;

  • show no signs of use;

  • include all labels, instructions, and accompanying documentation.

6.5. For hygiene and health protection reasons, the right of withdrawal does not apply to cosmetic products where the protective packaging, safety seal, or any other sealing element has been opened or removed after delivery.

6.6. Cosmetic products with opened packaging, products that have been used, or products that have been damaged are non-returnable and non-exchangeable, except in cases of manufacturing defects or incorrect goods supplied by the Seller.

6.7. The Store reserves the right to refuse acceptance of returned goods if the return conditions specified in this section have not been met.

6.8. Refunds shall be processed within 14 days from receipt of the withdrawal notice. However, the Store may withhold the refund until the returned goods have been received or proof of return shipment has been provided.

6.9. Products intended for professional use and purchased by legal entities, businesses, or self-employed persons acting within their commercial or professional activities are not subject to consumer withdrawal rights.

7. Exceptions to the Right of Withdrawal

In accordance with Paragraph 22 of Cabinet Regulation No. 255 of the Republic of Latvia, the right of withdrawal does not apply to:

  • cosmetic products whose protective packaging has been opened after delivery;

  • hygiene products after opening of their packaging;

  • products that have been used or damaged after delivery;

  • goods manufactured according to individual specifications or custom orders.

If the protective seal, protective film, or original packaging has been opened, the Seller reserves the right to refuse acceptance of the returned goods.

8. Personal Data Processing

The Seller processes personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR) and the Privacy Policy.

9. Intellectual Property

All materials, images, descriptions, logos, trademarks, and design elements published on the website are the property of the Seller or are used under valid authorization.

Copying, reproducing, distributing, or otherwise using any content without the Seller's prior written consent is prohibited.

10. Limitation of Liability

The Seller shall not be liable for any indirect losses, loss of profits, business interruption, or damages arising from the use of the website or products, except where such liability cannot be excluded under applicable law.

The Seller does not guarantee uninterrupted operation of the website and shall not be liable for temporary technical interruptions beyond its reasonable control.

11. Final Provisions

Any disputes shall first be resolved through negotiations between the parties.

If an agreement cannot be reached, disputes shall be resolved in accordance with the laws and regulations of the Republic of Latvia.
